DUI FAQs

  • I just got a DUI, what will happen to my driver's license and can I get a restricted License or Work Permit?
    • Upon being arrested for DUI and testing over the limit, you will be charged with a DUI or DWI and you lose your license until you are able to get setup on Ignition Interlock or we are able to resolve your case.
  • What is Ignition Interlock?
    • Ignition interlock is a program started in Minnesota as of July 1 2011 which allows a person to drive during their license revocation by using a device that tests their alcohol concentration before allowing them to start their vehicle.
  • What is the difference between DUI and DWI?
    • There is no difference. In Minnesota they are the same although some people use Driving while intoxicated to refer to alcohol and Driving under the influence to refer to being impaired by drugs, or a combination thereof, but it all falls under the same law. In Wisconsin it is called an OWI or Operating While Intoxicated.
  • What is the difference between Careless Driving versus DUI?
    • A careless driving is a traffic offense however, when a DUI charge is reduced to a careless it is actually treated as a careless driving alcohol related. In both cases the penalties and requirements for treatment or an alcohol assessment are usually very similar. Many insurance companies treat them similarly and in some cases they may have different loss of license time periods. Trying to get a DUI reduced to a careless driving is usually necessary when a DUI or DWI on their criminal record will affect their job or other status while a careless driving will not. Call to speak to an attorney about your charges to determine how this may affect you.
  • I already have a careless driving conviction on my record, how will that affect my DUI?
    • If the previous careless driving conviction was reduced from a DUI or DWI, it is a prior impaired incident, or alcohol related and will be used to enhance your current DUI charges to another level. Multiple DUIs can have significant impacts on your license and your freedoms. Call us to determine what you can do to defend your rights.
